This Privacy Policy ("Policy") describes how Trak Calories, Inc. ("trak," "we," "our," or "us") collects, uses, discloses, and otherwise processes your personal information when you use the trak mobile application (the "App"), as well as your privacy rights and choices.
This Policy forms part of our Terms & Conditions. Terms not defined here have the meaning given in the Terms & Conditions.
If you are under 13 years of age (or under 16 in the EEA/UK, where applicable), you should not use the App. If we become aware that a child under the applicable age has provided us with personal information, we will take steps to delete that information and the associated account.
Account information: name, email address, date of birth, sex, profile photo (optional).
Health and nutrition data: height, weight, weight goals, activity level, dietary preferences, food and meal entries (including photos you scan), calorie and macronutrient logs, and any other health-related information you choose to provide. This may constitute sensitive personal information under applicable law.
Support communications: information you provide when contacting trak Support, including your email address and the content of your message.
Subscription information: purchases and subscriptions are processed through the Apple App Store. Apple's terms govern payment processing, renewals, and refunds. trak does not directly collect or store your payment card information.
Usage and device data: app interactions, feature usage, crash reports, and device/OS information, collected through our product analytics provider.
trak does not use browser cookies, as trak is a native mobile application, not a website. trak does not use third-party advertising trackers.
Sign in with Apple / Sign in with Google: if you use these to create your account, we receive basic profile information (name, email) from that provider.
Apple HealthKit (if you grant permission): with your explicit permission, trak may read certain health data (such as steps or weight) from Apple Health. Information trak sends to or reads from HealthKit is also governed by Apple's own terms and privacy policy. trak does not use HealthKit data for advertising or marketing purposes, and does not sell or share this data with third parties for such purposes.

We share personal information only with the following categories of recipients, and only as necessary to operate the App:
We do not share your data with data brokers or advertising networks, and we do not have a public community/social feature that displays your personal information to other users.
Onboarding responses you provide before creating an account are stored locally on your device and in your private Apple iCloud/CloudKit account.
Once you create an account, your food and activity entries, goals, and other personal tracking data are stored in a secure remote database operated by our backend service provider. This is access-controlled so that each user can only access their own data through the App.
As with any remote database, authorized trak personnel can access this data through database administration tools where necessary for operating, maintaining, and securing the Service. This is standard practice for cloud-based applications that require internet connectivity, for example to process food scans through our nutrition data provider.
Account, authentication, and subscription data are also stored via our backend service provider and RevenueCat, respectively.

California residents have the right to know, access, delete, and correct personal information we hold, and to opt out of the sale or sharing of personal information. trak does not sell personal information.
Residents of these regions have rights under GDPR, including the rights above, and may lodge a complaint with their local data protection authority.

We retain your personal information for as long as necessary to provide the App's services, or as required by law.
If you delete your account, we will delete your account, food logs, goals, and other personal tracking data stored in our backend database within a reasonable timeframe, except where retention is required for legal, tax, or accounting purposes.
Onboarding responses stored locally or in your private iCloud account before account creation are managed by your device and Apple's iCloud settings.
We use reasonable technical and organizational measures designed to protect your personal information. However, no method of transmission or storage is 100% secure, and we cannot guarantee absolute security.
trak is based in the United States. If you use the App from outside the United States, your information may be transferred to and processed in the United States, where privacy laws may differ from those in your country.
The App is not directed to children under 13, or under 16 in the EEA/UK. We do not knowingly collect personal information from children under the applicable age.
We may update this Policy from time to time. We will notify you of material changes through the App or by other reasonable means. Your continued use of the App after changes take effect constitutes acceptance of the updated Policy.
